Inheritance left to your child could go to their spouse in a divorce

In Saskatchewan an inheritance received by your child during their marriage becomes “family property” that is subject to division between your child and his or her spouse in the event of a divorce. This is true even if it is received after separation but before a court proceeding is started. This is the case even if your Will specifies that only your child is to receive the inheritance. How your child will have to share their inheritance with their spouse will depend on the circumstances and the discretion of a judge. A legal agreement between your child and his or her spouse, required as part of your estate planning, could help you preserve the family wealth you have built and intend only to pass to your children.
