I did my will over 20 years ago

I have a will, but I did it over 20 years ago. When should I review it?

Congratulations on having done a will! Fewer than 50% of people (including lawyers) have a current will.

You are correct that your existing will should be reviewed regularly. Some suggest at least every 5 years. Certainly when there have been changes in your life. Consider the following:

1) Have you inherited a large amount, such that your estate planning should change?

2)Have you made gifts of property or cash to some of your heirs or beneficiaries, but not to all, or in differing amounts?

3) Is your executor still able to take on the job? Or should you name a different executor?

4) Do you have an alternate executor?

5) Are your children old enough and capable of being executors?

6) Are you widowed, divorced, re-partnered? Living together as spouses for 2 years is the equivalent of marriage, and your previous will is invalid.

7) Have you outlived the witnesses to your will?

If any of the above changes apply to you, or if you are uncertain if your existing will still meets your needs, please call 306-664-6900 or email reception@transitionslegal.ca for an appointment to discuss how to make your Will current.
